Terms of Service

These Terms of Service ("Terms") govern your use of Thika Superhighway at thikasuperhighwayvip.com (the "Site"). The Site is operated by Thika Superhighway, based in Nairobi, Kenya ("we", "us"). By entering or using the Site you accept these Terms. If you do not accept them, do not use the Site.

1. Adults only

The Site contains sexually explicit material intended for adults. You may use it only if you are at least 18 years old, or the age of majority where you live if that is higher, and if viewing such material is legal where you are. By entering the Site you confirm both. We may ask you to verify your age at any time and may refuse or end access if you cannot. See the Age Disclaimer.

2. Who appears on the Site

Content is published under creator profiles. Every person who appears in any content was 18 or older on the date it was produced, and we hold records proving this before anything is published. See the Record-Keeping Statement.

3. Subscriptions

Access to paid content is sold as subscriptions. A subscription is paid once and never renews or charges you again automatically.

• A subscription covers either one creator or all creators, as stated when you buy it.
• A subscription runs for the length stated when you buy it, starting when the payment is confirmed. A lifetime subscription has no end date for as long as the Site operates and your account is in good standing.
• The price and currency are shown before you pay. Some subscriptions are only available to members with an account.
• Subscriptions never renew automatically. Nothing is charged again unless you choose to buy another subscription.
• A subscription gives you a personal, non-transferable right to stream the covered content on the Site. It does not give you ownership of any content.

4. Paying

You can pay with the methods shown at checkout, such as M-Pesa, Airtel Money or bank transfer. Some payments are checked by our team before the subscription starts; the checkout page tells you when that applies. Card and crypto payments, when offered, are handled on the payment provider's own secure page and we never see your card number.

For a payment our team checks, you must give the phone number you paid from and the confirmation code from your payment message. Giving false payment details is a breach of these Terms.

5. Refunds

A subscription is not refundable once it has started, except where we could not give you access because of a fault on our side. In that case we will extend the subscription or refund it, whichever you prefer. To ask, write to [email protected] with your payment reference and what went wrong. We aim to reply within 7 days.

6. Your access and account

You do not need an account to buy a subscription. After paying, the device you paid on has access. To use your purchase on another device, restore access with your phone number and payment confirmation code, or create an account.

If you create an account:

• you sign in with a phone number or an email address and a password;
• keep your password private; you are responsible for activity on your account;
• we do not send you emails or text messages; your email or phone number is used only to sign you in and to find your purchases;
• you can delete your account at any time from Account settings. Payments you made are kept as financial records; see the Privacy Policy.

7. Acceptable use

You agree not to:

• download, record, screen-capture, copy, share, sell or redistribute any content, or help anyone else do so;
• get around the Site's protections, including video encryption, signed links, age checks or access checks;
• share your subscription, account or access with anyone else, or resell access;
• use bots, scrapers or other automated tools to access the Site;
• upload, request or promote content involving anyone under 18, anyone who did not consent, or anything illegal;
• harass creators, other users or our staff;
• use the Site in breach of any law that applies to you.

We may suspend or end access, without refund, for a breach of this section.

8. Content and intellectual property

All content on the Site belongs to its creators or to us, and is protected by copyright and other laws. The Site's name, design and software belong to us. Nothing in these Terms transfers any of these rights to you.

If you believe content on the Site infringes your rights or should not be there, follow the Content and Takedown Policy.

9. Availability and changes to the Site

We aim to keep the Site available, but we do not promise uninterrupted access. We may change, add or remove content, creators and features. Content covered by a subscription may be removed, for example at a creator's request or for legal reasons. If a large part of a creator's content is removed while your subscription to that creator is active, contact support and we may extend your subscription at our discretion.

10. Disclaimers and limits of liability

The Site is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by your device, your internet connection or events outside our reasonable control. Our total liability to you for any claim is limited to the amount you paid us for subscriptions in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to these Terms

We may update these Terms. The date at the top shows when they last changed. Changes apply from that date and do not affect subscriptions already bought. If you keep using the Site after a change, you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Kenya. Disputes go to the courts of Nairobi, unless the law where you live gives you the right to bring a claim there.
